In New Hampshire, the offense of drunk driving involves having a blood alcohol concentration (BAC) of 0.08 percent or higher, regardless of whether your driving ability was impaired, or situations in which your driving ability was actually impaired. For drivers under the age of 21, the maximum BAC is 0.02 percent. It is important to note that New Hampshire law also prohibits drivers from operating a motor vehicle under the influence of drugs.
