New Hampshire Alimony Lawyers
Divorce can take a debilitating toll on families. To go along with the stress of dissolving a union between man and wife, there are financial obligations that are taken into consideration as well. In divorce cases in New Hampshire, spousal support — popularly known as alimony — is defined as “an allowance for support made under court order to a divorced person by the former spouse, usually the chief provider during the marriage.” Spousal support may also be ordered to be paid if two people, even though they are not officially divorced as of yet, are legally separated, or no longer living together. Spousal support can be paid by either of the parties, depending on the specific circumstances involved.
Types of Alimony in New Hampshire
In New Hampshire, there are different types of alimony that the court can order. These include temporary alimony, which is given during the divorce process to help with immediate needs, and long-term alimony, which may be provided after the divorce is finalized to support the dependent spouse. Rehabilitative alimony is designed to help a spouse become self-sufficient, perhaps by paying for education or job training. Reimbursement alimony can be awarded to repay a spouse who supported the other through education or career advancement during the marriage.
How is Alimony Determined?
New Hampshire statute 458:31, Orders for Support of Spouse, states that if one member of a divorcing party relied on the other for financial support, then that dependent party will continue to rely on that financially supportive party as is deemed necessary by the court.
In awarding spousal support, the court uses a grouping of determining factors to arrive at a consensus as to how much the support payment should be. Duration of the marriage, the ages and health conditions of the parties involved, the current employment situations of the parties involved and how employable they are, the division of property between the two divorcing parties, and who the blame for the dissolution of marriage favors are all taken in consideration in order to calculate spousal support payments. However, spousal support is not always permanent, and will eventually dissipate altogether if determining factors change, such as if an ex-spouse decides to remarry or if an ex-spouse’s financial situation improves and support is no longer necessary.
Why Hire a New Hampshire Alimony Lawyer?
Divorce and alimony cases can be very complex and emotionally charged. In high-conflict cases, some spouses will fight very hard and even “play dirty” to avoid paying spousal support. Opposing counsel can be intimidating in order to not have you put up a fight for what you need and deserve to receive for spousal support.
At Tenn And Tenn, PA, we believe everyone deserves to move on from their marriage feeling like their alimony agreement is reasonable and does not take undue advantage of one spouse’s circumstances. Our New Hampshire alimony lawyers are here to help you navigate through this difficult time and ensure that your rights and financial well-being are protected.

Mistakes to Avoid in Alimony Cases
Not Understanding Your Financial Situation
One common mistake people make is not fully understanding their own financial situation. Whether you are paying or receiving alimony, knowing your income, expenses, and assets is crucial. This helps ensure that the alimony agreement is fair and realistic. Without this knowledge, you might agree to terms that are not in your best interest.
Ignoring the Importance of Documentation
Failing to keep proper financial records can hurt your case. Documentation of your income, expenses, and lifestyle during the marriage is important. This includes bank statements, tax returns, and receipts. These records provide a clear picture of your financial needs and capabilities. Not having these documents can make it difficult to support your claims in court.
Overlooking the Impact of Employment and Income Changes
Both paying and receiving parties often overlook how changes in employment and income can affect alimony. If you get a significant raise or lose your job, it can change the amount of alimony you pay or receive. It’s important to report these changes to the court to ensure the alimony arrangement remains fair.
Letting Emotions Drive Decisions
Divorce is emotional, but letting these emotions drive your decisions about alimony can lead to poor outcomes. It’s important to approach alimony with a clear, rational mindset. Making decisions out of anger or spite can result in agreements that are not in your best interest.
Failing to Seek Legal Advice
Perhaps the biggest mistake is not seeking legal advice. Alimony laws can be complex and having a knowledgeable lawyer can make a significant difference. Without legal guidance, you might miss out on important considerations and end up with an unfavorable alimony agreement.
