Residential home defects

Our client, a husband and wife, moved to NH to build their dream retirement home in a lovely New England suburb. The contractor hired many subcontractors with limited experience in residential construction and whose workmanship was substandard and in numerous cases, contrary to local building codes. After filing suit and attaching the contractor and subcontractor’s properties, a voluntary settlement was reached, which compensated our clients for the aggravation associated with the defective construction, and pain for a new contractor to perform all of the necessary repairs and complete their retirement home.

Disgruntled Homeowner sues contractor

Our client, a residential construction general contractor, was sued by a homeowner who alleged that the home they contracted and paid for contained numerous defects and violations of the BOCA Code. We successfully defended the litigation after demonstrating that no local building code had been adopted, and that the construction as performed complied with reasonable building practices in the community.

Driving While Intoxicated

We represented a middle aged woman who was pulled over on a Sunday morning by the New Hampshire State Police for speeding. Our client had just left the local health club, having completed a vigorous workout. Our client admitted to consuming alcohol approximately twelve hours earlier but had nothing thereafter. After failing roadside field sobriety tests, our client was arrested and subsequently charged with DUI. We successfully defended her at trial by demonstrating that the State did not have sufficient evidence to convict her of operating a motor vehicle while impaired to any degree, as a result of alcohol or drugs.

Drug Seizure

Our client, a young gentleman, was arrested for possession of drugs after local police entered his home following a noise complaint. A Motion to Suppress was filed arguing that the State did not have any basis to enter our client’s home and that the illicit materials found were seized in violation of our client’s constitutional rights. The Motion was granted and the case dismissed.

Single Car Collision, Traumatic Brain Injury

Our client, a 42 year old husband and father of two children was critically injured when he fell asleep at the wheel and his automobile crashed into a tree. The safety features of the automobile did not perform adequately and the unsafe seatbelt allowed him to slide into the steering column; the steering column failed to collapse, and the integrity of the drivers’ compartment did not withstand this low speed collision. Out client sustained severe physical injuries as well as a traumatic brain injury. The case settled after filing suit for a confidential amount.

Motorcycle Accidents, Severe Leg Injury

Our client, a 52 year old man was traveling on I-93 North when he was struck by a motor vehicle attempting to make an improper U-turn. He was airlifted to a local hospital for emergency medical attention for his injuries, which included a severe fracture and laceration of his leg. He received medical care which consisted of multiple surgeries, physical therapy, rehabilitation and wound management. His injury resulted in a permanent disability. The case settled before suit for a confidential amount.

Rear End Collision, Neck Injuries

Our client, a wife and mother of three young children, was rear ended when she stopped to avoid a pedestrian in the roadway. Her car was hit from behind and sustained moderate rear-end damage. She sustained a severe strain to her cervical and lumbar spine for which she received medical treatment. After approximately seven months of physical therapy she recovered from her injuries. The insurance company settled the case for a confidential amount after paying lost wages, medical expenses, and repairing the damage to her car.

Viscous Dog Bite, Facial lacerations

Our client, a 12 year old girl, was severely injured by a domesticated greyhound dog, which was previously used as a race dog. Without warning or provocation, the greyhound bit our client in her face, causing severe facial lacerations and injuries which required significant plastic surgery. A confidential settlement agreement was reached on behalf of our client. The settlement funds were invested in an annuity, which will be paid to her after her 18th birthday.

Grocery Store Slip and Fall, neck and back injuries

Our client, a 62 year old woman, was injured when she slipped and fell in a grocery store isle on an unknown liquid. The isle clerk admitted to being aware of the slippery substance, which had previously been reported, but not yet cleaned. Our client suffered severe neck and back injuries, for which she underwent many months of physical therapy treatment. This case resolved prior to suit for a favorable settlement amount, which included payment for our client’s pain and suffering, lost wages, and an amount for loss of consortium for her husband.
